--One of the worst parts is the DUID (driving under the influence of drugs) provision and the zero tolerance clause for those under the age of 21 despite that people under 21 can legally possess medical marijuana. Medical marijuana patients and recreational users can now be charged with DUID for being above the designated 5 ng (nano-gram) / ml (milliliter) THC blood content limit (or a ZERO tolerance 0 ng/ml limit for those under 21) which means users will be instantly guilty of a DUID and will have their constitutional right to a fair trial revoked if they refuse a police blood draw. Under previous laws the system required law enforcement to prove impairment in court for a guilty verdict to occur.

What's particularly nervy — galling, really — about the idea that the US ought to be spreading our democratic system across the globe is the fact that we don't have anything close to democracy in this country. Nor do we have what the Founders intended to create: a republic, where the power of the state is limited by the Constitution. This is underscored every time Americans go to the polls, where they are confronted with "choices" determined by lawmakers whose chief interest in life is getting reelected with as little opposition as possible. These guardians of the polity have made it virtually impossible for so-called third parties — i.e. parties not controlled by corporate interests and foreign lobbyists — to even get on the ballot.
--Isn't "democracy" wonderful?
Well, no, it isn't, not the current American version, which merely serves to legitimize — in a "legal" sense, at any rate — what is in reality an oligarchy. As this election season dramatized once again, the differences between the two state-subsidized state-privileged "parties" is chiefly rhetorical: this came through loud and clear during the Obama/Romney foreign policy "debate," but it's true on domestic issues as well. The bipartisan consensus is clear: maintain the Welfare-Warfare State pretty much as it has existed since the New Deal, with allowances made for trimming around the edges here and there. No matter who wins this election, the victor will have to impose a program of "austerity," i.e. burdening the lower and middle classes with new taxes and program cuts, while granting new opportunities for corruption and cronyism to the political class and the oligarchs, foreign as well as domestic.

Moral Hazard and the Devolution of Big Government

--The net result of these policies – borrowing immense sums to prop up an unsustainable Status Quo and institutionalizing moral hazard – leads to misallocation of scarce capital on a grand scale. In effect, the money borrowed by the federal government and electronically printed by the Federal Reserve is mal-invested, because those receiving the funding are personally not at risk and face no consequence if the money is squandered on speculation or unproductive programs. Once moral hazard has been institutionalized, it becomes a positive feedback loop. Since everyone in the system faces little personal consequence from mal-investment, the institution loses the ability to police itself.
Even worse, concentrations of private wealth readily influence public institutions via lobbying and political contributions, exacerbating moral hazard and mal-investment of the publicly borrowed money.
Erosion of Trust in Government
Mal-investment inevitably yields poor results, and just as inevitably, the government seeks to mask the dismal results of moral-hazard riddled policies and agencies. This "perception management" is driven by political expediency, as public outrage at failed policies and unproductive spending would eventually lead to a political price being paid by the leadership. So failed policies are declared great successes, negative data is massaged into positive data, and unflattering frauds involving public funds are buried or transformed into pseudo-realities.
This institutionalization of mal-investing borrowed funds and the politically expedient falsification of fact to manage perceptions have a destabilizing consequence: The public loses faith in public institutions.
