what to do with legal drivel

See PRE-HOMEWORK BELOW

Hi Folks ...

Most People base most decisions to do or not to do something, without full knowledge, and/or just a little knowledge about the subject or matter before them. In most cases, most People have very little if any understanding or comprehension of the information before them.

A Little Knowledge ...

They will be in possession of information and/or knowledge, and will not have critically processed and/or analysed the information/knowledge, but yet feel they can make, in many cases, life altering decisions, that in the main can be detrimental to their very well-being, and/or that of their family.

This can be especially true; when it comes to People dealing with the likes of Financial Institutions, Banks, Debt Collectors, Legal Practices, Commercial Corporations, "the State" and their agents/employees, and the Courts and Judiciary.

We did a search and scan through some of the "Public Forums" available online, that are indirectly and directly related to law. Absolutely NONE of those we found critically looked at or shared any information/knowledge that could prove to show People how to disseminate the plethora of misinformation and disinformation that a great many contributors were spewing out into these forums.

VERBAL DRIVEL:

From our perspective, most if not ALL of it was just verbal/written drivel. Plenty of contributors had plenty to share, say and opine, but none gave any guidance whatsoever on how to disseminate, analyse or critique the information and knowledge available.

The process of analysing and disseminating information or knowledge is a simple one, that if learned in the correct way/manner will exponentially increase your personal and professional abilities to deal with all manner of commercial and legal paperwork, alongside your ability to deal with a whole other set of other problems that many of us face in day to day life.

The Process is called "Critical Thinking" or "Socratic Thinking", and is founded upon logically examining the material and/or situation before you, in a very calm manner.

To Critique something; is to "Judge" and/or make a Judgement about something. In other words, you become the Judge on the matter before you, but only after you have considered ALL the relevant information, data, proofs, evidence etc. that can possibly be available. In other words, you are always seeking to attain the TRUTH. Then and only then are you in a position to make a Judgement call. Seeing the TRUTH of something, may take some time, but what you will learn about the matter, and more to the point, what you will learn about yourself, is immense.

You may be able (someday), to look at and/or consider almost any issue, without prejudice, assumption or bias. In other words, from a objective and logical point of view.

The process of "Critical Thinking" can be explained in five minutes, and learned by any reasonable Man or Woman within an hour, or thereafter. The application of your new found ability to Critically Think can be applied almost immediately, to virtually all/any legal/commercial issues, matters and/or concerns and beyond.

After that, all that remains is to practice, practice, practice.

The Common Law Society have run/facilitated three sets of Tutorials (to date) on "Critical Reading, Writing and Thinking", and have noted and noticed a complete upwards transformation in the skills and ability of the People that have participated in the Tutorials.

The Tutorials are (generally) run/facilitated over a three week period, for one evening a week for two hours per evening (sometimes more). Breaking the tutorials into three evenings, allows participants to go away and practice their new found skills, and come back to the Tutorials to get feedback on the work they have been set. The work set, is (usually) based upon a REAL LIFE scenario of a REAL Man or Woman facing some appropriate legal and/or commercial matter or issue.

Intense, Creative and Fun ...

Whilst each Tutorial can be intense, especially in the first fifteen minutes, once People get into the Critical Thinking mode, the atmosphere becomes more relaxed and the creative juices start to flow. Yes that's right, logic and critical thinking can be very creative and fun, or at least the Tutorials seem to be that way.

Should you want to learn something useful that is both creative and fun, on a Tuesday evening, book yourself and/or your partner/friend a place at the next set of Critical Thinking Tutorials here: www.Trivium4.eventbrite.com/

The next set of Critical Thinking Tutorials

start Tues. 13th. Oct. - 6pm to 8pm.

FINALLY TAKE NOTE: This set of Tutorials is already 50% booked up, so places may not be available for much longer. As many are aware (by now), we cannot facilitate People attending without booking ahead, and/or just showing up on the night. It is unfair to those who/m have taken the trouble to pre-book their places, and can disrupt the start of the Tutorials.

With all due respect, please do book

your place(s) well in advance here:

NOTE BELOW: The PRE-HOMEWORK for Trivium 4, Go On, Have a Go at this to see how you fair ...........

Dear Sir,

You recently wrote to Sean Rafferty, Fine Collection Services, and they have forwarded your letter to me. The Fine Collection Services (FCS) was awarded a contract to collect Court imposed fines following a tendering processing issued by the Department of Justice & Equality. FCS is an agent of the Courts Service in terms of collection of outstanding fines.

If a fined person does not pay their fine within the period allowed by Court, the Court Service forward the outstanding fine details to FCS. FCS issue warnings to the fined person informing him/her of the consequences of non payment.

If the fined person still refused to pay then a Committal Order will be made by a Judge of the District Court.  The Committal Order will be signed by the District Court Judge and forwarded to An Garda Siochana.  An Garda Siochana are empowered by law to execute the Committal Order and lodge the fined person to prison.  The fined person is at liberty to pay the outstanding fine at any time and thus avoid prison.

The power to arrest or seize goods resides with the District Court Judge.  The warning letter from FCS simply points out the possible consequences of not paying a Court imposed fine.

Judge O'Neill imposed a fine on you.  If you disagree with his decision then you are at liberty to appeal the decision to the Circuit Court.  The fine remains due and, in the event of non payment, a Committal Order will be made and will issue to An Garda Siochana.

I trust this is of assistance to you.

Yours sincerely,

Shay Keary

Office Manager
