After the article/mailshot on "The Best Ever Letter to a Debt Collector" which you can re-read/view once again here:

http://www.icontact-archive.com/6FnIU6Xpr7AsrExo_nHTm1IkX2Fpfu1O?w=3

... we got some very complimentary emails back from our readers. One reader asked us this question; "what has this Critical Thinking stuff measurably achieved?".

This is a great question, and to answer that, we did a quick bit of research into some of the measurable gains that the People we work with have achieved in the past month alone.

Five of the People we work with have had cases for possession orders struck out in the Circuit Court. In other words, Banks did not get to get their homes. Twelve cases have been adjourned/delayed to later dates (in the District, Circuit and High Courts), two of which have been adjourned for twelve months, all with the fancy stroke of a pen.  In minor Criminal matters, the People involved have either won their cases outright, and/or NO Order has been perfected, resulting in no fines, charges and/or prison sentences.

We cannot count how many People now have the personal confidence to deal with the legal challenges they face, without having to depend upon any other People (including ourselves), and we heard from a Man today, that he is using the process of Critical Thinking in other areas of his life that go way beyond legal and lawful applications.

We are considering doing, a series of Critical Thinking Talks for "The CLS Talks", and broadcasting same. But again, unless we are getting the ongoing and continuing support of you the/our readers, we will not be able to commit the time, energy and work that is required to get this project off the ground, and get to air.

Given that the next "Critical Thinking" Tutorial is going to be the last for 2015, this should provide us with the platform and practical means of support to set in motion and get a "Critical Thinking" series of programmes recorded, edited and brought to air.

If People do not feel the need to support this body of work that is fine, and we will drop the programme. On the other hand, if you do wish or want to add your support, all we ask is that you book a place on the next final "Critical Thinking" Tutorial. There are only a few more places to be filled, and this may also mean there is a need or call to run another set of Critical Thinking Tutorials next year.

The Critical Thinking Tutorials are probably the most important element that any Man or Woman needs, in getting to grips with the LAW. It is impossible to stress how important, but the above referenced recent results of People speak for themselves.

The Pre-Homework for the next Critical Thinking Tutorial (CTT) is below. We ask that ALL those who have booked, and are attending the next CTT, will print the letter, analyze it, attempt to fully address it, and bring it along with you next Tuesday.

~~~
THIS EXERCISE IS FOR EVERYONE:
The aim of the exercise is to Critically address the letter fully, and draft up the most appropriate response. Although we have had quite a few People attempting a response, none have fully addressed the serious issues raised by the Court Office Manager.
HINT: Perhaps People do not fully comprehend the serious threat of imprisonment that is inferred/implied by the said Shay Keary (Court Office Manager)?  Then again perhaps People do not want to deal with and/or give thought to such serious issues?
NOTE: Any Civil matter can end in a Criminal charge, whereby anyone can be faced by the Courts with a Criminal charge of contempt, even when we are simply standing on principle. NOBODY is immue from this.
Dear Sir,
You recently wrote to Sean Rafferty, Fine Collection Services, and they have forwarded your letter to me. The Fine Collection Services (FCS) was awarded a contract to collect Court imposed fines following a tendering processing issued by the Department of Justice & Equality. FCS is an agent of the Courts Service in terms of collection of outstanding fines.
If a fined person does not pay their fine within the period allowed by Court, the Court Service forward the outstanding fine details to FCS. FCS issue warnings to the fined person informing him/her of the consequences of non payment.
If the fined person still refused to pay then a Committal Order will be made by a Judge of the District Court.  The Committal Order will be signed by the District Court Judge and forwarded to An Garda Siochana.  An Garda Siochana are empowered by law to execute the Committal Order and lodge the fined person to prison.  The fined person is at liberty to pay the outstanding fine at any time and thus avoid prison.
The power to arrest or seize goods resides with the District Court Judge.  The warning letter from FCS simply points out the possible consequences of not paying a Court imposed fine.
Judge O'Neill imposed a fine on you.  If you disagree with his decision then you are at liberty to appeal the decision to the Circuit Court.  The fine remains due and, in the event of non payment, a Committal Order will be made and will issue to An Garda Siochana.
I trust this is of assistance to you.
Yours sincerely,
Shay Keary
Office Manager
